Employment Law – Miller Johnson Updates
It’s time for the annual legal update? Already? Didn’t we just do this? How can that be?
Whether time itself has been distorted by COVID-world or our updates are equivalent to trips to the dentist, it’s true: we are once again ready to sprint through the most salient developments in employment law and employee benefits since we last met. And despite the fact that we gathered only 7 months ago, there is plenty left to talk about. Here are some of the topics:
Where do employers stand with respect to COVID anyway? Can we make people come back to work? Can we mandate vaccinations? What if we just want to incentivize them—any issues there? What orders/rules/case law/regulations/ordinances are still in place?
How does the issue of reasonable accommodation for religion and disability factor into our decisions?
What are the legal changes stemming from the November elections? What is going on with the leadership and priorities of the EEOC and the DOL? Are there executive orders of significance? I heard the FFCRA was extended again?
What is the PRO Act and why should it make me nervous?
Fill in the blank: President Biden has stated that he will be “The most pro-____ president you’ve ever seen.” Assuming we can solve this riddle, what should we be doing about it?
What are the significant legislative changes that impact employer-sponsored group health plans? (Hint: they are probably the most significant changes since the ACA).
What do we need to know about optional flexibility for FSAs and COBRA subsides?
Will the world ever return to normal?
